Definition

Exclusivity Rights are contractual provisions that restrict a creator from working with competing brands, platforms, or individuals within a defined category, territory, or time period. In brand deal negotiations, exclusivity clauses are common — a sponsor may require that a creator not promote any competing products for the duration of the campaign or for a specified period afterward. Exclusivity significantly increases the value of a partnership and should command a premium fee. Creators should carefully define the scope of exclusivity (category, geography, duration) and ensure the compensation reflects the opportunity cost of turning away competing deals.
